NEW BOOK PUBLICATION

COPYRIGHT AND CULTURAL INSTITUTIONS: GUIDELINES FOR DIGITIZATION FOR U.S. LIBRARIES, ARCHIVES, AND MUSEUMS

Peter B. Hirtle, Emily Hudson, and Andrew T. Kenyon

Ithaca , NY : Cornell University Library Press, 2009

Digital communications technologies have led to fundamental changes in the ways that cultural institutions fulfil their public missions of access, preservation, research, and education. Institutions are developing publicly-accessible websites in which users can visit online exhibitions, search collection databases, access images of collection items, and in some cases create their own digital content. Digitization, however, also raises the possibility of copyright infringement. “Copyright and Digitization” aims to assist understanding and compliance with copyright law across libraries, archives, and museums. It discusses the exclusive rights of the copyright owner, the major exemptions used by cultural heritage institutions, and stresses the importance of risk assessment when conducting any digitization project. It also includes two cases studies, examining digitizing oral histories and student work.

NEW RESEARCH PROJECTS

Discovery Project:
Defamation and Privacy: Law, Media and Public Speech
2009-2013

Defamation and privacy laws have changed dramatically in recent years. The changes mean that law must understand and evaluate far more carefully the practices of journalists and other media professionals. This project empirically examines the changes, investigating media production, content and litigation. It critically reviews legal limitations on public speech through analysing the effects and interaction of defamation and privacy laws within international and interdisciplinary contexts. Addressing the need for greater legal awareness of popular media and journalism, the project responds to central questions in legal and media practice.

Chief Investigator: Professor Andrew Kenyon

2009 Joint Research Project
Open for Business? China's Telecommunications Market and the WTO

China joined the World Trade Organization (WTO) in 2001 after almost 15 years of negotiations, making extensive commitments to open its markets to foreign investment and trade. This project examines the extent to which China is meeting its WTO obligations in the telecommunications sector, which is of particular concern to countries such as Australia and the United States.
This project is jointly funded by Telstra and the University of Melbourne.
