Can the Spam Act 2003 independently protect the Public against Spam, or are additional Legally Sanctioned Technology Based Solutions Required?

This article seeks to determine the optimal approach, from an Australian perspective, for controlling the spam problem . Whilst the Spam Act 2003 (Cth) is effective in ensuring that spam does not originate within the jurisdiction, the Act can do little to control the bulk of spam, which originates overseas. Network operators within Australia must, therefore, rely on technological solutions to control spam.

This article concludes that any effective solution to the problem would combine well designed, and integrated, technological and legal solutions . Further, any suitable legal solution must be founded upon effective globally harmonised anti-spam legislation.
