Civil Defamation Law in China

As defamation law and defamation litigation in China developed in tandem with the transformation and commercialization of the media, it would be tempting to understand Chinese defamation law as one of the authoritative means to suppress the newly commercialized media. This article examines the current legal framework of civil defamation law in China, both in its statutory basis and as applied in judicial proceedings in terms of elements of defamation, litigants, defences and remedies. The investigation of the legal framework suggests that Chinese civil defamation law does not deviate from defamation law’s legitimate purpose of reputation protection and has become increasingly sensitive to the institutional function of the media and the value of freedom of expression.
