  Land Claims in East Timor: A Preliminary Assessment

Daniel Fitzpatrick is a Lecturer, Faculty of Law, Australian National University. Visiting Professor, Faculty of Law, University of Muenster, Germany.

Pending development of new laws and institutions, land in East Timor may be claimed on four bases: underlying traditional interests; titles issued in the Portuguese or Indonesian eras; or occupation since the 1999 vote for independence. This article gives a preliminary assessment and taxonomy of these competing claims. Case studies are provided throughout, drawn from three monthsÂ’ work during 2000 with the United Nations Transitional Authority in East Timor.
