This presentation examines the response of three
jurisdictions to these issues and from the perspective
of deliberative democracy advocates a five element
framework for the development of election
communications law. Several superior court cases from
each jurisdiction are assessed and the practice of
election lawyers and regulators from across the three
jurisdictions provide the basis of a socio-legal
analysis of how election communications law is devised
and practised.
